It is a common misconception that estate planning is important for only those with money or who are advanced in age. If you own property over $20,000 your children or family could be subject to probate. By investing the time now to plan your estate you could possibly save your loved ones months if not years of agony and literally thousands of dollars in court fees and/or estate taxes.
Probate
When someone pases and has prepared a valid will or has not prepared any Estate Planning documents their estate is probated. The probate process can last from 6 months to 2 years depending on the jurisdiction and size of the estate. Disputes amongst beneficiaries can be settled through the probate court that can also extend the time for the probate process. The probate process can also lessen the time allowed creditors to make claims against your estate. Please contact our office if your loved one has passed and you need to discuss what you need to do to insure you properly handle their property and estate.
